Fondoo

Terms of Service

The agreement for using the hosted Fondoo service: accounts, your agents, your content, payments, plans and the rules both sides follow.

Effective October 22, 2026legal@getfondoo.com

These terms are an agreement between you and Fondoo, a sole proprietorship based in Arizona, United States ("Fondoo", "we", "us"). They cover the hosted Fondoo service at getfondoo.com, including the dashboard, the MCP connection, the REST API, webhooks and hosted sites (together, the "Service").

By creating an account, claiming a business, or using the Service, you agree to these terms and to the policies they link to:

If you use the Service for a company, you confirm you can bind that company, and "you" means the company.

1. What Fondoo is

Fondoo is a platform where you, and the AI agents you connect (for example ChatGPT, Claude, Codex or Cursor), can create and run online businesses: websites, checkout, email, social posting, SEO, support tickets, analytics, automations and an app backend.

Open source vs hosted. Fondoo's core is open source. The source code is licensed under its own licenses (AGPL-3.0 for the core, MIT for SDKs and related tools, and GPL-2.0-or-later for the WordPress plugin). If you self-host the code, those licenses govern your use, not these terms. These terms apply only to the hosted Service we run. The open-source licenses do not grant rights to the Fondoo name or logo.

2. Who can use it

  • You must be at least 18 and able to form a binding contract.
  • You must give accurate account information and keep it current.
  • You may not use the Service if you are barred from doing so under US law, including sanctions laws.

3. Your account and access

  • You are responsible for everything done through your account, your API keys and the agents you connect.
  • Keep your password, API keys and connection links private. Tell us at legal@getfondoo.com if you think your account or a key was compromised.
  • Agent-started businesses. An agent may start a business before a human has an account. Until a human claims it, it is a draft. We may delete unclaimed drafts after a reasonable period. Once you claim a business, it is part of your account and covered by these terms.
  • Some actions are human-only by design: identity checks (KYC), entering card details, approving OAuth connections, and setting spending caps.

4. Agents act on your behalf

When you connect an AI agent or create an API key, you authorize it to act in your account within the permissions you grant.

  • Actions taken by your agents are your actions. You are responsible for them as if you took them yourself, including the content they publish and the messages they send.
  • Write actions can be previewed before they run. Actions that delete data, spend money or email a list need human approval.
  • Agents can never issue refunds, send payouts or move money.
  • Every agent and API action is recorded in your workspace audit log.

Details are in the AI and Agents Policy.

5. Your content

"Your content" means everything you, your team or your agents put into the Service: pages, posts, emails, products, files, code, contact lists, support tickets and data from connected services.

  • You own your content. We don't claim ownership.
  • You give us a limited, worldwide, non-exclusive license to host, store, copy, process, transmit and display your content only as needed to run, secure and improve the Service and as you direct (for example, publishing a post to a social network you connected).
  • You confirm you have the rights to your content and that it complies with the law and our Acceptable Use Policy.
  • We don't use your content to train AI models, and we don't use your content in our marketing without your permission.

6. Personal data you handle

Your business will collect personal data about your own customers, subscribers, visitors and app users (for example in support tickets, orders and email lists). For that data, you decide what is collected and why, and we process it on your behalf.

  • You are responsible for having a lawful basis for that data and for telling people how you use it (your own privacy notice).
  • Our Data Processing Agreement applies to that processing and forms part of these terms.
  • Sensitive data. Don't use the Service to store health information protected by HIPAA, payment card numbers (outside Stripe's own fields), government ID numbers, or other special-category data, unless a feature is clearly built for it. We don't sign HIPAA business associate agreements.
  • Children. Don't use the Service to knowingly collect personal data from children under 13 (or under 16 where local law sets a higher age).

7. Email and social posting

  • Email may only go to people who expect it: your app's users, your customers, and subscribers who opted in. Newsletters use double opt-in. Every marketing email includes one-click unsubscribe. We automatically suppress addresses that bounce, complain or unsubscribe, and you may not work around that suppression.
  • Cold outreach and purchased, rented or scraped lists are prohibited. So are cold SMS and AI-made phone calls.
  • Social posting runs through our sub-processor Upload-Post, with daily posting caps per network. Reddit and Lemmy posts are posted only after a human approves each one. You must follow each network's own rules.

8. Payments for your business (Stripe Connect)

Fondoo checkout uses Stripe Connect. When you accept payments through Fondoo:

  • Your sales are made by you, through your own Stripe connected account. You are the seller and merchant of record. Charges are made directly on your Stripe account.
  • Stripe terms. Payment processing services for Fondoo users are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (together, the "Stripe Services Agreement"). By agreeing to these terms or continuing to accept payments through Fondoo, you agree to be bound by the Stripe Services Agreement, as Stripe may modify it from time to time. As a condition of Fondoo enabling payment processing through Stripe, you agree to give Fondoo accurate and complete information about you and your business, and you authorize Fondoo to share it and transaction information related to your use of Stripe's services.
  • Fees. Stripe charges its own processing fees directly to your Stripe account. Fondoo takes an application fee of 1% of each sale made through Fondoo checkout. The fee is 0% when you use your own Stripe Payment Links.
  • Refunds, disputes and losses on your sales are between you, your buyers and Stripe, under the Stripe Services Agreement. You handle refunds yourself in Stripe; agents cannot issue them.
  • You are responsible for your products, prices, delivery, customer service, and any taxes on your sales.
  • If you connect your own Stripe account in direct mode or another payment provider, that provider's terms apply.

9. Plans, usage charges and billing

  • Hosted plans are priced per site per month. Current prices and included allowances are on our pricing page. At launch: $24 per site for sites 1 to 3, $20 for sites 4 to 10, $17 for sites 11 to 50, and custom pricing above 50. Paying yearly takes 15% off.
  • Usage charges apply beyond what each site includes every month. At launch: agent actions over 25,000 ($2.50 per 10,000, or $1.25 per 10,000 beyond 1M), visitors over 50,000 ($8 per 100,000, or $5 per 100,000 beyond 5M), events and webhooks over 50,000 ($10 per 100,000), emails over 5,000 ($0.60 per 1,000), storage over 5 GB ($0.50/GB), X posts with links ($0.50 each, only after an explicit confirmation) and extra social sets ($3 per month). Domains you buy cost the price shown when you buy them, and you approve every purchase.
  • Card-on-file purchases (such as domains) are limited by spending caps you set and may require an approval link.
  • Trial. New accounts start a 7-day trial for $0 with a card. On day 7 the card is charged for the plan unless you cancel before then.
  • Founding discount. The first 100 paying customers get 20% off for life on monthly plans for sites 1 to 10. It does not combine with yearly pricing and does not apply to sites 11 to 50 or to usage charges.
  • Plans renew monthly until you cancel. No partial-month refunds.
  • We may change prices with at least 30 days' notice. If a vendor we rely on changes its costs, we may change included allowances with at least 30 days' notice.

Full details are in the Refund and Billing Policy.

10. Third-party services

The Service connects to services you choose (for example Stripe, Shopify, WordPress, GitHub, Google, social networks, AI providers and your own AI agent).

  • Your use of them is governed by their terms and privacy policies.
  • When you connect a service, you direct us to send it the data needed for that connection. For example, if your agent reads a support ticket, that ticket's contents go to your agent's provider.
  • We aren't responsible for third-party services, their outages, or changes to their APIs or rules that limit what Fondoo can do.

11. Acceptable use

You and your agents must follow the Acceptable Use Policy. It bans spam, cold email, scams, prohibited businesses, impersonation, malware, IP infringement and automated abuse, among other things.

If you believe content on the Service infringes your copyright, send a notice to legal@getfondoo.com with: your contact details, the work you claim is infringed, the URL of the infringing material, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner, and your physical or electronic signature. We may remove the material and, for repeat infringers, close accounts.

13. Suspension and termination

  • You can cancel at any time in the dashboard. Your plan runs to the end of the current billing period.
  • We may suspend or end your access, remove content, or pause specific features (such as email sending or posting) if you or your agents break these terms or our policies, if you don't pay, if your use creates legal or security risk, or if we're required to by law or by a provider such as Stripe. Where reasonable, we'll tell you first and give you a chance to fix the problem.
  • Your data after termination. After your account closes, you have 30 days to export your data. After that, we delete it as described in our Privacy Policy.
  • Sections that by their nature should survive (fees owed, content license for backups during deletion, disclaimers, liability limits, indemnity, governing law) survive termination.

14. Changes to the Service and these terms

  • The Service will change over time. We may add, change or remove features. Some features may be marked beta; they are provided as-is and may be withdrawn.
  • We may update these terms. For material changes, we'll give at least 30 days' notice by email or in the dashboard. If you keep using the Service after the change takes effect, the new terms apply. If you don't agree, cancel before then.

15. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

In particular:

  • We don't promise the Service will be uninterrupted, error-free or always available. We offer no uptime guarantee.
  • We don't promise any business result, such as traffic, search rankings, revenue, deliverability or social reach.
  • Content written by AI agents (yours or anyone's) can be wrong. Our checks reduce some risks but don't guarantee accuracy or legality. You are responsible for reviewing what gets published.
  • You are responsible for keeping your own copies of important content.

16. Limitation of liability

To the fullest extent the law allows:

  • We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
  • Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100.

Some places don't allow these limits, so they apply only as far as the law permits.

17. Indemnity

You agree to defend and indemnify Fondoo against claims, losses and costs (including reasonable legal fees) arising from your content, your business and products, your agents' actions, your use of third-party services, or your breach of these terms or the law.

18. Governing law and disputes

These terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in Arizona, and both parties consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court. Before filing a claim, please contact us at legal@getfondoo.com so we can try to resolve it informally.

If you are a consumer in a country whose law gives you rights these terms can't override, those rights still apply.

19. General

  • Entire agreement. These terms and the linked policies are the whole agreement between us about the Service.
  • Order of precedence. If documents conflict: the Data Processing Agreement controls for personal data; otherwise these terms control over the linked policies.
  • No waiver. Not enforcing a right isn't giving it up.
  • Severability. If part of these terms is unenforceable, the rest still applies.
  • Assignment. You may not transfer these terms without our consent. We may transfer them in connection with a sale or reorganization of the business.
  • Force majeure. Neither party is liable for delays caused by events beyond reasonable control, including provider outages.
  • Notices. We'll send notices to your account email. Send notices to us at legal@getfondoo.com.
